Terms & Conditions

Introduction

This document includes the terms of use of the WeMaster website and services. You should also read our Privacy Policy, which details our information handling practices. A brief explanation of the Terms of Use, which in no way represent a legal contract, is included in the boxes.

Acceptance of the conditions

You must read, understand and agree to these Terms of Use ("Terms") before accessing wemaster.pro or any of its links ("the Site"). By accessing the Site, you become subject to these Terms, which, together with our Privacy Policy, govern our relationship with you. You may enter only after you have read and accepted the Terms.
You agree that WeMaster may use the information you share as set forth in our Privacy Policy at https://wemaster.pro/, attached hereto.

Site Description

The Site is a virtual community for professionals. Within WeMaster you will be able to contribute and learn in forums, meet other professionals, take and teach courses, and find employment. On the Site you may also post images, photos, share promotions, and take advantage of and purchase services if you wish ("Services"). The Services include, but are not limited to, any content or services available or offered through WeMaster, in addition to any offerings of materials displayed, transmitted or developed within the Site or through the Services. Content ("Content") includes, but is not limited to, text, user comments, messages, information, data, graphics, news, articles, photographs, videos, sounds, images, artwork and software.

Accessing the Site

You may occasionally be unable to access the Site or your browsing may be interrupted due to equipment failure, upgrades, maintenance or any other reason beyond WeMaster's control. WeMaster reserves the right to suspend or discontinue the Site or any service and to remove any content as it deems appropriate at any time without notice. In addition, it may set certain limits on certain features and services or restrict your access to spaces or to the Site and its Services generally, without notice and without liability.
You must not store images, photographs, videos, sounds or any other content within the Site. It is your responsibility to keep copies of all content posted on the Site.

Registration

You may be required to create an account with WeMaster in order to use some of our Services. To do so, you will be asked for a password and a user name, as well as some registration information. You must provide accurate, complete and current information. Failure to do so is a violation of the Terms and Conditions and may result in immediate account termination.

As a user name you may not use the name of another person or entity to which you have no rights, nor any name or mark whose rights belong to another person or entity unless you have the proper authorization, nor a name that confuses readers into thinking that you are another person or company, nor any name that is offensive, vulgar or obscene.

It is your responsibility to safeguard your login information and you are solely responsible for any activity within your account. If you experience a breach of security or identify any unauthorized activity, you must notify WeMaster immediately. WeMaster is not responsible for any act or omission by you, including any damages resulting from the foregoing.

The Services are exclusively for persons over 16 years of age. Parents or legal guardians are advised that the Site does not publish violent or nude photographs or images that may offend some people.

If the user happens to be a company, it is the company that accepts the conditions.

Only a human being can register an account. It is forbidden to open accounts to robots or automated methods.

You may access the landing pages of our Services from anywhere in the world, although this does not ensure that all Services or features are available in your country or that any User Generated Content is legal in your country of residence. WeMaster may restrict access to some Services (or features or Content) in some countries. It is your responsibility as a user to ensure that the Services you have purchased are legal in your country of residence. Not all Services are available in all languages.

Fees

WeMaster reserves the right to change its fees or charges for services offered on the Site (or to begin charging for any free services), provided that any fees paid prior to such changes will not be affected.

User Behavior

If you manage an account, comment in any of our forums, post material or links within the Site or otherwise make any material available (or allow any third party to do so) through the Site, you will be solely responsible for what is contained in such Content - and any harm resulting therefrom. This applies to any Content (images, video, sounds, links, etc.). WeMaster does not control the Content posted by its users and, therefore, we do not guarantee its accuracy, integrity or quality. You understand that by accessing the Site you will be exposed to Content that may be offensive, indecent or objectionable.

As a condition of use, you agree not to use the Services for any purpose that is unlawful or prohibited by these Terms or for any other purpose unrelated to WeMaster. As examples, but not limited to these, you agree not to use the Services to:

Generate or send unsolicited email or "spam" to any person or URL.
Publish Content for which you do not own the copyright, except in the Forums, where you may do so as long as you mention the name of the author and include a link to the source of such Content.

Use any type of robot, spiders, scrapers or any other automated means (excluding RSS feeds) to access the Site for any purpose without written permission. You further agree not to (i) proceed in any manner that imposes or would impose, in our sole discretion, an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the Site or any of the activities on the Site; or (iii) circumvent any of the measures we use to prevent or restrict access to the Site.

Artificially increase or alter the number of votes or comments, or other Service, for the purpose of giving or receiving money or any other form of compensation for such votes; engage in acts that in any way alter the results of the Services.

By sharing Content, you represent and warrant that:

Your use of such Content will not violate the proprietary rights, including but not limited to copyright, patent, trademark or trade secret rights of any third party.

If your employer owns the rights to any intellectual property you generate, you have (i) received permission from your employer to post or share the Content, including but not limited to any software or (ii) obtained a waiver of rights from your employer.
You respect any third party licenses associated with the Content.
The Content does not carry and will not transmit viruses, worms, malware, Trojan horses or any other harmful or destructive content.
You will use the Site and its Services in compliance with WeMaster's Privacy Policy, its Terms and Conditions and any other legal notices posted on the WeMaster Site, but also with applicable laws and regulations (including, without limitation, local laws or regulations in your country, state, city or governmental area concerning online behavior and acceptable content, including laws applicable to and concerning the transmission of technical data exported from the United States or your country of residence).

If you suspect any abuse of the Site or a violation of the Terms (other than copyright infringement, which if applicable should be addressed to "Copyright Complaints"), please send us an email with an explanation to: info@wemaster.pro.

WeMaster reserves the right to ban any user from its Services. It also reserves the right to remove any Content (including but not limited to projects, comments, messages, avatars, etc.) for any reason it deems necessary.

WeMaster, without limiting itself to any of these representations or warranties, has the right (but not the obligation) to (i) refuse or remove any Content that, in its sole opinion, violates the Terms or is harmful or objectionable or (ii) terminate or prohibit access to the Site to persons or entities for any reason it deems necessary.
You alone are responsible for your interactions with other users within the Site. WeMaster reserves the right, but has no obligation, to follow up on disputes between users.

Content shared or submitted to appear on the Site

You will retain all rights and intellectual property rights to your Content. WeMaster will not claim any rights to your Content.

However, by uploading or submitting Content to the Site, you grant WeMaster (and affiliates and partners) a non-exclusive, worldwide license to communicate, distribute, host, modify or derive works (solely for the purpose of displaying it in the best manner), perform, publish, reproduce, store or use such Content. The license serves only to operate, sell, promote and improve our Services. If we choose to include your work in any WeMaster feature or promotional material we will give you credit for the Content.
In addition, by submitting your Content, you grant WeMaster and its users and visitors the right to share it through various WeMaster integrated social media platforms (such as Pinterest, Facebook or Twitter).

WeMaster does not represent or warrant that Content you post on the Site will not be copied illegally and without your consent. WeMaster also does not prohibit users and visitors to the Site from making low-resolution copies or thumbnails of Content posted on the Site, so you hereby authorize WeMaster to permit users and visitors to the Site to make such low-resolution copies of your Content.

You represent and warrant that you shall have no right to revoke the permissions granted herein, nor shall you seek, obtain or assert any injunctive or other relief against WeMaster; you hereby expressly and irrevocably waive all such rights and assign them to WeMaster.
You may terminate your license at any time by removing your Content from the Services portion. If you delete Content, WeMaster will attempt to remove it from the Site, but you should be aware that caching and references to it may not be made immediately unavailable. You also agree that WeMaster may retain and use copies of your Content for archival, backup or research purposes as discussed below.

Responsibilities of Visitors to the Site

WeMaster has not reviewed and cannot review all of the material posted on the Site and therefore cannot be responsible for the content, its use or its effect on you. WeMaster, as operator of the Site, does not imply or represent that it endorses the material posted, nor does it warrant that the material posted is accurate, useful or non-harmful. You are responsible for taking precautions to protect your computer from viruses, worms, Trojan horses or other harmful content. You may encounter material that is offensive, indecent or otherwise objectionable; content that contains technical inaccuracies, typographical or other errors. The Site may also include material that violates the privacy, publicity rights or other intellectual property or other rights of third parties; or downloading, copying or use subject to other terms and conditions whether or not previously stated. WeMaster disclaims any responsibility for any harm resulting from the use by visitors of the Site or from any downloading by those visitors of Content there posted.

You also agree that if you encounter Content that may be offensive or annoying to you but which complies with the Terms, your sole remedy is to stop viewing the Content in question. On the other hand, if such Content violates the Terms, you agree that your sole remedy is to report it by sending a detailed e-mail to info@wemaster.pro.

Copyright Complaints. DMCA (Digital Millennium Copyright Act) Notifications and Content Removal Procedure.

WeMaster has adopted the following policy regarding copyright infringement within the Site, pursuant to the Digital Millennium Copyright Act (a copy can be found at http://www.loc.gov/copyright/legislation/dmca.pdf, the "DMCA").

If you believe that the Site hosts Content that infringes your copyright, please send a written notice to our Copyright Officer (address below). The notice should include:

A description of the copyrighted work or works that you believe have been infringed.

The exact address (URL) at which the infringing material is located.
Contact information, such as e-mail address, mailing address, and telephone number.
A statement that you have a good faith belief that use of the material identified in the notification is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf.

Your signature.

Before submitting a notice of infringement, determine whether the material in question is protected by the "fair use" doctrine, as you may be liable for appropriate charges and attorney's fees if you request removal of any non-infringing content. Please make sure that you have not authorized the use (for example, if you authorized a professional in your company to use such materials as samples of their work). If you do not know whether the use of the copyrighted material violates the law, call a lawyer. It would also be a good idea to consult public materials such as those found on the U.S. Copyright Protection site, on their website (www.copyright.gov) or on the Lumen database (www.lumendatabase.org).

WeMaster will take up to 30 days to respond to valid DMCA requests. In any case, if you have not received a response within this period, please email us at info@wemaster.pro to confirm receipt of the original complaint. As I'm sure you are aware, spam filters can sometimes reject mail from important senders.

WeMaster, in an attempt at transparency by removing or restricting access to Content posted by users, may post any DMCA notices (without contact information). The notice may be posted on a public-facing website or other methods.

After restricting access to the material pursuant to a valid DMCA notice, WeMaster will promptly notify the user responsible for the alleged infringement that his or her material has been removed or access to it has been disabled.

WeMaster reserves the right to terminate the account of any user who has received more than one DMCA notice.

If you believe that the removal or disabling of your Content was the result of a mistaken notice of infringement, please send a written notice to our Copyright Officer (information is below) containing:
A description of the mistakenly removed work, plus your user name and the location of the work within the Site.

Contact information, such as e-mail address, mailing address and telephone number.

A signed statement, under penalty of perjury, stating in good faith that we mistakenly removed or blocked the material.

Your consent to jurisdiction in the Federal Court in your district of residence (or in Florida County, Miami, if you live outside the United States) and acceptance of service of process by the person who sent the notice under DMCA subsection (c)(1)(C), or a representative of such person.

Before sending a notice, make sure that the material used violates copyright law, as the process could cost you, among other things, attorney's fees, if the court decides that the material was not removed in error. If you are not sure whether your use of the material violated copyright law, call a lawyer. It may also be a good idea to consult public materials such as those found on the U.S. Copyright Protection website (www.copyright.gov) or the Lumen database (www.lumendatabase.org).

Upon receipt of a valid notice, WeMaster will forward it to the party that sent the original DMCA notice. Thereafter, the party who sent the notice (either the rights owner or the person representing the rights owner) will have ten (10) days to inform us if they have taken legal action with respect to the material in question. If WeMaster does not receive the information within that ten-day period, we will reinstate the material on our Services.

This is the mailing address of WeMaster's Copyright Officer:

8260 Nw St - Suite 409 - Doral, FL. 33122 - USA.

Or you can send us an email to: info@wemaster.pro

We care about copyright. If an error occurs, please follow the procedure. If there is something you don't understand, please email us at info@wemaster.pro.

Jobs

WeMaster has no control over the jobs posted within the Jobs section. You understand and agree that we have no control over the content or any other information. We also have no way of ensuring the identities of users or employers and, therefore, WeMaster is not responsible for the content, accuracy, completeness, legality, reliability or availability of the jobs, their specifications or website included in the offer.

Without limiting the generality of the foregoing, WeMaster reserves the right (and is not obligated) to withdraw any job posting that directly or indirectly discriminates against applicants. Direct discrimination is discrimination in which offers solicit candidates with specific characteristics, thereby excluding people because of their gender, race, age or disability. Indirect discrimination is where bids implicitly exclude certain types of applicants, making it virtually impossible for them to meet the requirements for the job. You understand and agree that it is your responsibility to refrain from posting offers that directly or indirectly discriminate against individuals.

Some people may post illegal or fraudulent job postings, for which we are not responsible.

Teaching or taking classes

WeMaster is also a community marketplace where you can learn from professionals through virtual classes ("Classes").

These Terms, the Privacy Policy and other legal notices published by WeMaster are separate from the agreements, communications and other documents (the "Class Agreements") that student and teacher may enter into within the Class, including the Class Agreements within the Site. Both students and teachers are responsible for complying with the terms set forth in the Class Agreements, but WeMaster has no control over the other party's compliance. Among other things, WeMaster cannot control (a) the terms of the Class Agreements, (b) the truthfulness or legality of the Class Agreements or (c) the performance by either party of its obligations under the Class Agreements. Accordingly, WeMaster will not be liable for any obligations contained in the Class Agreements or for any actions taken in reliance thereon and will not be deemed a party to any transactions between you and any other user. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE WEMASTER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE "WEMASTER PARTIES") FROM ANY DAMAGES OR CLAIMS, KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, DISCLOSED OR UNDISCLOSED, RELATING TO ANY DISPUTE RELATING TO THE CLASS AGREEMENTS OR ANY OTHER TRANSACTION OR ATTEMPTED TRANSACTION WITH ANOTHER USER OF THE SERVICE (STUDENT OR TEACHER). YOU AGREE, UNDERSTAND AND INTEND THAT THIS ASSUMPTION OF RISK AND RELEASE INCLUDES YOU AND YOUR OFFSPRING, EXECUTORS, AGENTS, ADMINISTRATORS AND ASSIGNS.

You expressly acknowledge and accept the risk and liability for use of the Site, the Classes and all Content and Services within the website. THE CLASSES (INCLUDING THEIR CONTENT) ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. YOU ASSUME FULL RESPONSIBILITY AND RISK FOR YOUR USE OF THE ONLINE COURSES AND THEIR CONTENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT (A) THE CONTENT OR CLASSES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS OR ACHIEVE THE DESIRED OBJECTIVES, (B) THE CLASSES WILL BE UNINTERRUPTED OR UNINTERRUPTED, SECURE OR ERROR-FREE, (C) THE INFORMATION OR CONTENT OBTAINED FROM THE CLASSES, SUCH AS CHAT SERVICES, WILL BE ACCURATE, COMPLETE, CURRENT, ERROR-FREE, COMPLETELY SECURE OR RELIABLE, OR (D) ERRORS IN CONTENT WILL BE CORRECTED. YOU ASSUME THE RISK OF PERSONAL INJURY, INCLUDING DEATH OR DAMAGE TO PERSONAL PROPERTY, FROM USE OF THE CLASSES AND THEIR CONTENT.
If applicable, you waive the Florida Civil Code Section, which provides in relevant part: "A GENERAL RELEASE DOES NOT INCLUDE CLAIMS IN YOUR FAVOR WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT OF THEIR EXISTENCE AT THE TIME OF RELEASE AND WHICH, IF KNOWN OF, SHOULD HAVE AFFECTED YOUR AGREEMENT WITH THE DEBTOR IN A MATERIAL MANNER".

WeMaster reserves the right to - but is under no obligation to - remove the offer of any class, at any time and for any reason.

Special rules for students

You agree to all terms and conditions, including the cancellation policy posted on the Site, when you reserve a place in WeMaster classes.

All Classes offered on WeMaster will be held available only on the dates stated.

You agree to follow all reasonable rules established by the teacher for the Class and not to take any action that interferes with the performance of the teacher or other students in the Class.
You agree to take the Class only for educational purposes and never with the intention of copying materials or techniques for your benefit or to take to other classes, or to disrupt any Class or the teacher's relationship with your students.

By paying for the Class you will be entitled to unlimited downloads of the Class materials. The materials will remain available for 30 days within your account from the date of activation.

As a student, when you enroll in a class, whether it is a free or paid class, WeMaster gives you a license to view the class through the WeMaster platform and Services, who in turn is the licensor of record. You are licensed to access the classes, but we are not selling them to you. This license does not grant you any right to resell the class in any way (including by sharing your account information with a buyer or illegally downloading the class and sharing it on torrent download sites).

In fuller legal terms, WeMaster grants you (as a student) a limited, non-exclusive, non-transferable license to access and view the classes and associated content for which you have paid all required fees, solely for personal, non-commercial, educational purposes through the Services, in accordance with these Terms and any conditions or restrictions associated with a particular class or feature of our Services. All other uses are expressly prohibited. You may not reproduce, redistribute, transmit, assign, sell, retransmit, rent, share, loan, modify, adapt, edit or create derivative works, sublet, transfer or use any kind, unless we give you explicit permission to do so in a written agreement signed by an authorized WeMaster representative. This also applies to content you may access through any of our APIs, if any.

We generally grant a lifetime access license to our students when they enroll in a class. However, as a matter of legal liability, access expires after one year and we reserve the right to revoke any license to access and use classes at any time, in the event that we decide or are required to remove access to a class due to legal reasons; for example, if the class you have enrolled in is the subject of a copyright complaint or if we determine that your content violates our terms. Access does not apply to additional features or services associated with a class; for example, teachers may disable translations of class captions at any time or decide to stop offering educational assistance or Q&A services related to a class. More explicitly, access is to the class content, but not to the teacher.

Special rules for teachers

By offering a class on WeMaster you assume full responsibility for its content. In addition, you understand that it remains open to the public and any student can view and enroll in it.

By offering any class on WeMaster you agree to comply with wemaster.pro's registration according to the price and schedule defined on the Site and not to refuse enrollment or attendance of any student based on illegal or discriminatory criteria.

You represent and warrant to WeMaster that you are qualified to teach the classes offered on the Site and that you will conduct yourself in a professional manner and in accordance with applicable laws.

You agree not to misuse students' personal information. Misuse means using it, without the student's permission, for any purpose that has not been detailed in the class.

You also understand that, in teaching a class, students will have the opportunity to rate your experience and give you feedback. We cannot control the content of their ratings and are not responsible for the information or opinions the user includes in the comment.
As a teacher, you assign the rights to the content of your class. We will also retain the rights to use that content and give it to students who have paid for the class.

You understand and acknowledge that WeMaster shall have the right to refuse your services as a teacher, with or without justification. You further acknowledge that WeMaster shall have the right to decide the subject matter, content and scope of the class.
You have read, understand and agree to the Class Guidelines and Eligibility Requirements. You also understand and agree that we will not cover the cost of preparing a class that does not pass our approval process.

Cancellation and Refunds for Classes

WeMaster will not be responsible for refunds for classes, unless it is a refund period for virtual classes.
Students will receive a full refund if the class is cancelled after the enrollment period but before the start of the course.

Links

Both the Site and third parties may suggest links to other websites. Since WeMaster has no control over other sites, you acknowledge and agree that we are not responsible for the availability of external sites and do not endorse and are not responsible or liable for any content, advertising, products or other materials on or available from such sites. You further acknowledge and agree that WeMaster shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with any use of or reliance on any such content, goods or services available on or through these sites.

Some people may post links for which we are not responsible.

Research

WeMaster does not screen all Content posted on the Service, although we use available technology to filter or screen for certain illegal content (such as child pornography) and other types of offensive content or conduct (for example, patterns of use that give away "spam" or password or identity hunting).

We may enter or post information about you or your browsing within the Service (a) when required by law (for example, if we are served with a subpoena or search warrant); (b) to assist you with customer service; or (c) if we believe or believe it is necessary to protect the rights, property or safety of WeMaster, our users or the general public.

We may search for illegal content within your own Content.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW THAT WEMASTER PROVIDES THE SITE, SERVICES, CONTENT AND MATERIAL ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE. FOR EXAMPLE, WE MAKE NO WARRANTY THAT (a) THE SERVICES, CONTENT, OR MATERIALS WILL MEET YOUR REQUIREMENTS OR WILL REMAIN AVAILABLE, ACCURATE, ERROR-FREE AT ALL TIMES; (b) THE RESULTS OBTAINED FROM USE OF THE SITE, SERVICES, CONTENT OR MATERIALS WILL BE EFFECTIVE, ACCURATE OR RELIABLE; OR THAT (c) ANY ERRORS OR DEFECTS IN THE SITE, SERVICES, CONTENT OR MATERIALS WILL BE CORRECTED. Neither WeMaster nor its suppliers and licensors, makes any warranty that the site will be error free or that access thereto will be uninterrupted or continuous at all times. You understand that you download or otherwise obtain content or services through the Site at your own risk.

Limitation of Liability

Neither WeMaster nor its suppliers or assigns shall, in any event for any part of these Terms, under any contract, negligence, strict liability or any other legal or equitable theory, be liable for: (i) special, incidental or consequential damages; (ii) the cost of procurement or replacement products or services; (iii) interruption of use or loss or misuse of data; (iv) amounts in excess of amounts paid to WeMaster under these Terms during the twelve (12) months prior to the event. WeMaster shall also not be liable for any failure or delay caused by situations beyond its control. The foregoing shall not apply to the extent prohibited by applicable law.

WeMaster may terminate your access to all or any part of the Site, at any time and without cause, effective immediately.
You may stop using the Services at any time. You may also delete your account by going to the account settings and clicking on the "I would like to delete my WeMaster account" option. After you delete it, we will delete your profile and information related to you, favorites, comments, although it may not happen immediately. WeMaster cannot delete forum topics and replies, although we will delete your name and unlink your profile from all activity.
